Terms of Service Privacy Policy
WebShristy is a brand operated by Webshristy Enterprises, an Udyam-registered MSME based in New Delhi, India. These Terms of Service govern your use of this website and your purchase or use of our digital products and services.
1. Acceptance and eligibility
By accessing the website, creating an account, placing an order or using a product or service, you agree to these Terms, the Privacy Policy, Refund Policy and any product-specific terms shown before purchase. You must be legally capable of entering into a contract. If you act for an organisation, you confirm that you are authorised to bind it.
2. Accounts and security
You must provide accurate information and keep your credentials confidential. You are responsible for activity performed through your account and should notify us promptly if you suspect unauthorised access. We may restrict an account when reasonably necessary to investigate fraud, abuse, a security issue or a material breach of these Terms.
3. Products, compatibility and delivery
Our products are downloadable software and related documentation. The product page states the intended platform, key functionality, compatibility information and price. You are responsible for checking disclosed requirements before purchase and for maintaining suitable backups and a safe test environment.
After confirmed payment, access is normally provided through your account and/or email. Delivery may be delayed while a payment or fraud check is pending. Download limits, update periods or support periods apply only where stated on the product page or order.
4. Prices, taxes and payment
Prices and the transaction currency are displayed before checkout. Applicable taxes and the final total are shown before you authorise payment. Payments are processed by the payment gateway selected at checkout; we do not store full card numbers or card security codes. You authorise us and the payment provider to process the transaction and relevant fraud-prevention checks.
If a price or description contains an obvious error, we may cancel the affected order and return the amount paid. You must not initiate an improper chargeback for a validly delivered order; please contact us first so we can investigate.
5. Software licence and intellectual property
Purchase transfers no ownership in the software. It grants the limited right described in our License Agreement and any product-specific licence. WebShristy, its software, documentation, branding and website content remain protected by applicable intellectual-property law. You may not redistribute, resell, publish, sublicense or provide purchased files to an unauthorised third party.
6. Support, updates and third-party platforms
Included support and updates, if any, are described on the product page. Support does not cover unsupported platform versions, unauthorised redistribution, third-party code changes, server administration or bespoke development unless agreed separately. CS-Cart, Shopware, Moodle and other third-party names belong to their respective owners; our products are not endorsed by those owners unless expressly stated.
7. Custom services
Custom development, integration and maintenance work is governed by the accepted proposal, statement of work or written quotation in addition to these Terms. That document controls where it expressly differs, including scope, milestones, acceptance, fees, ownership and support.
8. Acceptable use
You must not use the website or our products to break the law, infringe rights, introduce malicious code, defeat licensing or security controls, scrape or overload the service, gain unauthorised access, or facilitate fraud. We may suspend access proportionately while investigating such conduct.
9. Cancellations and refunds
Digital-product refunds and payment reversals are governed by our Refund Policy. Nothing in these Terms excludes a remedy that cannot lawfully be excluded under applicable consumer law.
10. Availability and warranties
We aim to describe and deliver products accurately, but software may not be uninterrupted or error-free in every environment. Except for express commitments and non-excludable statutory rights, the website and products are provided on an “as available” basis. You remain responsible for backups, configuration, access controls, testing and deployment decisions.
11. Liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental or consequential loss that was not reasonably foreseeable. Our aggregate liability arising from a purchased product will not exceed the amount paid for that product during the 12 months before the claim. These limits do not apply to fraud, wilful misconduct, infringement, breach of confidentiality, or liability that law does not permit us to limit.
12. Termination
You may stop using the service at any time. We may terminate or suspend access for a material breach, fraud, unlawful use or security risk after reasonable notice where practicable. Clauses intended to survive termination—including payment, intellectual property, licence restrictions, disclaimers and liability—continue to apply.
13. Governing law and disputes
These Terms are governed by the laws of India. Please first contact us so we can try to resolve a concern. Subject to any mandatory consumer forum or statutory jurisdiction, courts in New Delhi, India will have jurisdiction.
14. Changes
We may update these Terms for legal, security or operational reasons. The revised version and its update date will appear here. Changes do not retroactively reduce rights attached to a completed purchase without a lawful basis.
